This Privacy Policy explains our policies about the collection, use, and disclosure of your information concerning your access to and use of the services, which includes those provided through our websites, applications, and emails (jointly, the “Service”). The terms “we,” “us,” and “M. Barker” refers to M. Barker T/A WhichVoIP.co.za.
THE INFORMATION WE COLLECT FROM USERS AND HOW WE USE IT
We may collect and store information about you concerning your use of the Service, including any information you transmit to us through the Service.
Account Information: If you create an account to access and use the Service, we may store and use the information you provide during the process, such as email address (very important), full name, physical address, zip code and other information you can provide such as your gender and phone number. We may publicly display your first name, as well as a photo, or other content you submit during registration, as a part of your account profile. You are allowed to modify the information associated with your account by visiting your account setting.
Public Content: Your business listing and contributions to the Service are meant for the use of the general public, and as such, they are viewable to the public, including ratings, reviews, lists, files, tips, compliments, posts, news posts, and edits to the business listing information. Your account profile information (such as your name and profile picture) are also meant for the general public, so is some of your activity through the Service, such as how you relate, vote, or comment on other people’s contributions. You can restrict the public nature of some of these activities if you so choose, through your account settings.
Communications: When you create the account, sign up, or subscribe to use certain features of the Service, you are subscribing to receive messages from other users, businesses, and us. You can modify some of your communication preferences but kindly be informed that you cannot unsubscribe from receiving certain legal, administrative, or transactional information from us. We may store or retain information that you provide through your interactions with us, including phone calls, electronic messages or in person.
Transaction: If you attempt a transaction through the Service, such as a purchase, we may collect and store information about you such as your full name, email, phone number and payment information, alongside any other information you provide to us, for us to process your transaction, communicate with you pertaining the transaction, and fill forms for future transactions. This information may be shared with a relevant third party, and third parties may share information with us, for the same purposes. When you submit your payment information, the information is encrypted with the aid of industry-standard technology. If you provide feedback and reviews about businesses with which you transact through the Service, we may publicly display that you have negotiated with those businesses.
Activity: We may store information about your navigation and use of the Service, which includes your search activity, pages you visit, date and time of such visits, businesses you contacted using our applications, purchases, and transactions you make via the Service. We may also store the information that your device may provide us as a result of your access to and use of the Service, such as your IP address, browser type, device type, browser language, phone number, mobile carrier, unique device identifiers, location (including GPS location, beacon-based location, and geolocation), and requested and referring URLs and mobile applications. We may also receive and store your precise location information whenever our applications are running (including when running in the background) if you allow our app to access such information in the course of your use of the Service. You may be able to disallow or restrict our access to and use of precise location information through your device or browser settings, this can be managed by adjusting the Location Settings on your device.
COOKIES POLICY
We and third parties which serves as our subsidiaries may use cookies, tags, web beacons, scripts, advertising identifiers (such as mobile identifiers which includes Google Advertising ID) and any other similar technology (“cookies”) as a result of your access to and use of the Service, third-party websites and applications. Cookies are stored only during an individual session.
You can set your preferences or choices regarding the use of cookies through your device or browser setting, but by doing so, the performance and the functionality of the Service will be affected. The process of disabling cookies may vary from one device to another and from one browser to another, but generally, they are found in your browser or device preferences or security settings. For instance, Android and iOS devices each have settings that are designed to reduce forms of ad tracking. In terms of flash cookies, you can manage your preferences or choices. Please be informed that changing any of these settings does not prevent you from seeing certain advertisements.

Third Parties may receive certain personal information about you. Such includes:
Advertisers: We may permit third parties to use cookies to collect the same type of information and for the same intentions as we do. Also, we may share non-personal information about you, such as advertiser identifiers, location information, or a general account identifier (such as an email address), with third parties for the purpose of advertising programs and data analytics, including with third parties that help to confirm the efficacy of various advertising programs by collating information they obtain from multiple sources similar to the Service. Hence, data analytics tools like Facebook Pixel, Google Analytics, Google Tag Manager, Google Adwords and Adsense will be used on the Service. Also, MailerLite will be used for our newsletter.
Service Providers: We may depend on third-party service providers to provide or support some of the features that are available through the Service (such as reservation). Also, we may rely on third-party service providers to carry out specific operations on our behalf, as a result of your access to and use of the Service, such as hosting and communications services, technical and customer support, network security, tracking and reporting functions, quality assurance testing, transaction processing, our marketing of the Service, and other necessary purposes. We may share information about you that is relevant to the activities of the service providers so they can carry out their services or fulfil your requests. In such cases, third-party service providers agree to use your information according to the intended purpose.
Anonymous or Aggregate Information: We may share your information in aggregate with third parties, such as businesses that are listed on telecomsdirectory.ca and content distributors. For instance, we may display the number of users that have viewed or clicked on certain advertisements. We may also disclose anonymous information about your access to and use of the Service.
Business Transfers: We may disclose information about you with our parent companies, affiliates, joint ventures, or other businesses under common control, in such circumstances, we will mandate them to regard this Privacy Policy. If any companies acquire or all or substantially most of our assets, the company will possess the same information and will assume the obligations and rights concerning the information as defined in this Privacy Policy.
Legal Disclosures and Investigations: We may probe and disclose your information if we have a good-faith belief that such disclosures or investigations are mandatory in compliance with a legal proceeding, and law enforcement orders and instructions, which may include a search warrant, statute, subpoena, judicial processes, or other enforcement requests or legal process served on us.
Links: The Service may contain links to third-party websites and services, such as a business URL. Unless, as expressly defined in this Privacy Policy, we do not share your personal information with them, neither are we responsible for their privacy practices. We admonished that you carefully study their privacy practices before relating to the services.
Third-Party Accounts: If you subscribe for or log in to WhichVoIP.co.za using a third service such as Google or Facebook, or you link your account on our Service to a third-party service such as Instagram, Twitter, or Facebook, we may receive information about you from the third-party service. If you post content to a third-party platform through the Service, that third party will also receive the content, which will be viewable to any person that accesses it through that third-party service.
Businesses on the Service: We may share information about you (such as your gender, and city), your device, and your navigation on the Service (which may include which business you contact, bookmark or visit using the URL) with companies listed on WhichVoIP.co.za. You may adjust your account settings to modify the information about you that we disclose. Be reminded that businesses can still view public activity and post, and may receive information about you when you relate or transact with them, through the Service, regardless of your settings. Also, if you contact a business listed on the Service, we may disclose your information about the details of your call with the business which the business had received directly from you due to the call, such as the date and time and your phone number. Also, you may be able to limit our ability to collect and disclose your phone number through your phone service provider or phone settings.
MANAGING YOUR PERSONAL INFORMATION
Other users may be able to recognize you or link you to your account if you add personal information to the content you post publicly. You can limit the risk of being recognized by using pseudonyms, though doing so may reduce the credibility of your contributions. Please be informed that messages you send and receive via the Service are strictly private, to the extent both of you agreed to keep it so. For instance, if you send a message to a business, that user may decide to post it to the general public. Also, we may review, access, and disclose such messages as a result of an investigation relating to the use of the Service, as well as our measures to improve the Service.
ACCOUNT TERMINATION AND DATA RETENTION
You can close your account when you deem it fit. We will remove certain public posts from the general view and dissociate them from your account. We may retain or withhold some of your personal information for the purpose described in this Privacy Policy unless restricted by law. For instance, we may retain your information to investigate, prevent, or identify possible violations that are connected with the Service or to comply with legal proceedings. Please be informed that businesses cannot remove their ratings, business listings, or reviews by closing their accounts.
CHILDREN POLICY
The Service is meant for the general public and not directed to minors under the age of 13. We do not, in full understanding, collect personal information from such minors. If you are aware that a child has submitted personal information without a parental agreement, kindly contact us. If we discover that a minor under 13 has provided personal information to us without parental knowledge, we will take prompt steps to remove such information and deactivate such an account.
DATA SECURITY
We have taken necessary security measures to safeguard the personal information submitted to us, during transfer, and when we receive it. However, no method of data transfer over the internet is entirely secure. Therefore, we will strive to use industrially acceptable standards to secure your personal information, but we cannot guarantee its absolute safety.
UPDATES TO THIS PRIVACY POLICY
We may update this Privacy Policy periodically. The updated version of the Privacy Policy will be valid, and as such, will govern our collection, use, and disclosure of your information and will be located on our website. If we affect any material changes to this Privacy Policy, we will promptly notify you via email or by posting a notice to that effect on the website on or before the effective date of the updates. Your further access to and use of the Service after the effective date shall construe your acceptance of the updated Privacy Policy.

RIGHTS OF EU AND DATA SUBJECTS
Under EU regulation and guidelines, you have the following rights in respect of your personal information:

3) to remove or delete your personal information in certain circumstances where:
4) you believe that it is no longer essential for us to retain your personal information;
5) we are processing your information for legitimate interests, and you oppose such processing, and we cannot provide a legal overruling ground for the processing;
6) where you have submitted your information to use at your discretion, and you decide to withdraw such consent, and there is no other ground for us to process your personal information; and
7) where you believe that your personal information, we retain is unlawfully processed by us;
8)to limit the processing of your personal information where:
9) the correctness of the personal information is challenged;
10) the processing of personal information is illegal, but you oppose the erasure of personal details;
11) we no longer require the personal details for the intentions we originally collected, but it is required for the exercise or defence of a claim; or

to contest processing which we have validated based on our legitimate interest;

In addition to the regulations above, you have the right to submit a complaint with the authority involved in data protection.
We will request additional information from you to ascertain your identity and for security reasons before disclosing the data you requested. We reserve the sole right to charge a levy where the applicable law permits.
